These terms govern your use of the MugBar app for iOS and watchOS ("the App"). By downloading or using the App, you agree to them.

1. License

MugBar grants you a personal, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, in accordance with these terms and the Apple Media Services Terms and Conditions. You may not sell, rent, redistribute, or attempt to reverse engineer the App except to the extent that applicable law expressly permits.

2. Subscription and billing

MugBar is a subscription. Full access to the App's features, on both iPhone and Apple Watch, requires an active subscription, offered as a monthly or yearly plan and normally starting with a free trial. The plans, prices, and trial length in effect are shown in the App before you purchase.

Payment is charged to your Apple Account when you confirm the purchase. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period, and your account is charged for renewal within the 24 hours before the period ends. You can manage your subscription and turn off auto-renew in your Apple Account settings. If you subscribe during a free trial, any unused portion of that trial is forfeited.

Purchases, renewals, and refunds are handled by Apple under the Apple Media Services Terms and Conditions, not by us. We may change prices or plans for future billing periods; a change takes effect only after the current period ends, subject to any notice Apple requires. Cancelling stops future charges, and access continues until the end of the period you have already paid for.

3. Hardware compatibility

MugBar is an independent companion app that communicates with a compatible smart mug over Bluetooth. It works with the Ember® Mug but is not affiliated with, endorsed by, or sponsored by Ember Technologies, Inc. We do not manufacture, sell, or support the mug hardware itself. Changes to the mug's firmware or hardware, or to your device's operating system, may affect or break compatibility, and we cannot guarantee uninterrupted operation.

4. No warranty

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free, uninterrupted, or accurate. Temperature and battery readings are provided for convenience only and should not be relied upon for safety-critical decisions.

5. Limitation of liability

To the maximum extent permitted by law, in no event shall the developer be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of, or inability to use, the App. Our total liability for any claim relating to the App shall not exceed the amount you paid for it, if any.

6. Acceptable use

You agree to use the App only for lawful purposes and not to interfere with or disrupt its operation or the devices it connects to.

7. Changes to the App and these terms

We may update, modify, or discontinue the App or any of its features at any time. We may also update these terms; the current version will always be posted on this page with a revised "Last updated" date. Continued use after changes take effect constitutes acceptance.

8. Termination

This license remains in effect until terminated. It terminates automatically if you breach these terms. You may terminate it at any time by deleting the App. Deleting the App does not cancel an active subscription — cancel that in your Apple Account settings.

9. Governing law

These terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable therein, without regard to conflict of law principles.
